ZapQuest Terms of Service

These Terms of Service ("Terms") govern your use of ZapQuest, an AI-powered quest and learning studio for children aged 4–17, operated under the Caffeine platform. Please read these Terms carefully before creating an account. By registering, you confirm that you are a parent or legal guardian aged 18 or over.

1. Acceptance of Terms

By creating a ZapQuest family account, the parent or legal guardian ("you") agrees to these Terms of Service on behalf of yourself and your children. If you do not agree, please do not use ZapQuest. Children may not create accounts independently — all accounts require parent/guardian registration.

2. Account Use & Parental Responsibility

You are responsible for maintaining the security of your Internet Identity login and family code. You agree to supervise your children's use of ZapQuest, ensure they are in the appropriate age group (4-7, 8-12, or 13-17), and review all quests, ebooks, and debate content before approving it for your children. You must not share your account credentials with anyone outside your immediate family.

3. Age Requirements

ZapQuest is designed for children aged 4–17 under direct parental supervision. Parents and guardians must be at least 18 years old to create a family account. By registering a child on ZapQuest, you confirm that you are their parent or legal guardian and that all age group information provided is accurate.

4. Content Moderation & Parental Approval

All AI-generated content (quests, ebooks, debate topics) passes through our safety layer before being submitted for parental approval. Parents must review and approve content before children can access it. ZapQuest reserves the right to block, modify, or remove content that violates our safety guidelines, without notice. We do not guarantee that all content will be error-free or perfectly age-appropriate in every context.

5. AI-Generated Content Disclaimer

ZapQuest uses Google Gemini AI to generate educational quest content. While we apply rigorous safety filters, AI-generated content may occasionally contain inaccuracies or imperfections. ZapQuest is not liable for errors in AI-generated content. All content is intended for educational entertainment purposes only and should not be used as professional advice in any field (medical, legal, financial, etc.).

6. Credits & Billing

Each family receives 10 free credits on registration. Additional credits can be purchased through our payment provider (Stripe). Credits are non-refundable once used. Unused purchased credits may be refunded within 14 days of purchase if no quests have been generated with them — contact support to request a refund. ZapQuest reserves the right to change credit pricing with 30 days' notice to registered families.

7. Subscriptions & Cancellation

ZapQuest currently operates on a credit-based (pay-as-you-go) model with no recurring subscriptions. If subscription plans are introduced, they will be clearly communicated and families will have the option to cancel before being charged.

8. Privacy & Data Collection

We collect limited personal data including parent name, children's names, age groups, and quest/ebook content. This data is used solely to provide and improve ZapQuest services. We comply with COPPA (US), GDPR (EU), and the Kenya Data Protection Act 2019. We do not sell, rent, or share personal data with advertisers. See our Privacy Policy for full details.

9. Intellectual Property

ZapQuest owns all platform code, design, and original content. AI-generated quests and ebooks created on the platform are co-owned by ZapQuest and the creating family. By using ZapQuest, you grant us a non-exclusive licence to display and moderate user-submitted content for platform operations. You may not copy, scrape, or reproduce ZapQuest's platform, design, or proprietary content.

10. Prohibited Use

You agree not to: attempt to bypass parental controls or safety filters; submit prompts containing hate speech, violence, or adult content; attempt to extract, scrape, or reverse-engineer platform data or AI outputs; use ZapQuest for commercial purposes without written consent; impersonate another family or user; or use ZapQuest in any way that violates applicable law.

11. Limitation of Liability

ZapQuest is provided 'as is'. To the fullest extent permitted by law, ZapQuest and its operators are not liable for indirect, incidental, or consequential damages arising from use of the platform, including but not limited to loss of data, missed educational outcomes, or errors in AI-generated content. Our total liability is limited to the amount you paid for credits in the 30 days preceding any claim.

12. Governing Law

These Terms are governed by the laws of Kenya, consistent with the Kenya Data Protection Act 2019 and applicable international standards including the US Children's Online Privacy Protection Act (COPPA) and EU General Data Protection Regulation (GDPR). Any disputes shall be resolved under Kenyan law in the first instance, except where international consumer protection law requires otherwise.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered families by email or in-app notification at least 14 days before material changes take effect. Continued use of ZapQuest after that date constitutes acceptance of the updated Terms.
